Our cl rank is determined on a weight GPA, and I'm not first because of technicality, should I complain?

So we just got done with our first semester of our senior year, and the top of our cl has a 5.0 and I have a 4.91. The thing is, I have all high-A's, like him, but he is in Honors Spanish 5 and I'm in Honors French 4 and his cl apparently has more weight. However, he took Spanish 1 in eighth grade allowing him to take this Spanish 5 his senior year. French was not available until my ninth grade year, and I didn't take Spanish in eighth because i really wanted to learn french. So because I wanted to take French and not Spanish, he has a higher rank? Should I inquire about this to my guidance counselor?
